ORDER OF THE BOARD
(by ~J.Anderson):
On September
22,
1986, Celotex filed what it has entitled
a
Rmotion
to require
the
Agency
to comply with
35
Ill.
Adm. Code
101.106”.
The Agency filed
a response
in opposition on September
23,
and on September 24,
Celotex
filed a reply accompanied by
a
motion for leave
to file instanter, which
is hereby granted.
Although the Board notes
that the Agency’s September
17,
1986 letter
to
the Clerk was somewhat unclear,
it has been
clarified
in the above—referenced pleadings.
The Agency has
essentially filed an additional appearance
in this case, that of
Mr. Hurst who has a temporary license
to practice law pursuant
to
Supreme Court Rule 711.
Finding that there
is
no procedural
impropriety,
the Board
hereby denies Celotex’ motion.
IT
IS SO ORDERED.
