ORDER OF THE BOARD (by M.E. Tristano):
On May 20, 2002, petitioner filed a petition for variance (petition) from the volatile
organic material (VOM) emission reduction requirements of 35 Ill. Adm. Code Part 215,
Subpart T. The petitioner requests a variance from July 1, 2002 until December 31, 2006 to
allow it sufficient time to evaluate and implement potential options for controlling VOM
emissions from dryers at its facility in Decatur, Illinois. The Board accepts the matter for
hearing.
The petition was accompanied by a motion for expedited review and/or retroactive
relief. On June 4, 2002, petitioner filed a motion to withdraw motion for expedited review
and/or retroactive relief. The Board grants the motion.
The Board directs that this matter proceed to hearing as expeditiously as practicable.
The assigned hearing officer must set the matter for hearing in accordance with the
requirements of the Environmental Protection Act (415 ILCS 5
et seq
. (2000)) and the Board’s
procedural rules. It is the responsibility of the hearing officer to guide the parties toward
prompt resolution of this matter, through whatever status calls and hearing officer orders he
determines are necessary and appropriate.
