ORDER OF THE BOARD

This matter comes before the Board upon a July 8,
1983
petition for release from bond filed by the AMAX Coal Company
and a July 18, 1983 motion in support of that petition filed by
the Illinois Environmental Protection Agency (Agency).
On April 25,
1972 the Board entered an order in this matter
which required Ayrshire Coal Company, a predecessor of AMAX, to
post a performance bond in an amount equal
to the cost of the
ordered abatement plane
Such bond was posted prior to June
1,
1972.
AMAX alleges,
and the Agency agrees, that the abatement
plan has now been completed to the satisfaction of the Agency,
and both request that the bond be released.
The Board finds that the abatement plan has been satisfactorily
completed and that the bond is no longer necessary.
The Board,
therefore, orders the bond released.
AMAX also alleges,
again with Agency concurrence, that it
has become necessary to transfer a portion of the drainage from
its pollution control system from its original location and requests
that the Agency be ordered to modify its NPDES permit to reflect
that change.
Again, the Board agrees and orders the Agency to modify
NPDES Permit No. IL0047945 to relocate the discharge permit
in the Dā2 drainage system to the outfall of the No.
4 coal pit.
