Petition was filed with the Board
in the form of
a complaint
seeking an Order
in
the nature of
a
temporary cease and desist order
directed to the City of Rockford, requiring
it
to “temporarily
cease and desist any and all installation and operation”of
a pro-
posed landfill site in Winnebago County, and further seeks a
revocation of a permit issued to the City of Rockford by the
Environmental Protection Agency authorizing such installation.
The Board is aware of the rendition by
the
Supreme Court of
Illinois of case entitled Kathryn O’Connor v. City of Rockford,
issued on October
2, 1972 in Case No. 45021.
We direct
the parties
to file simultaneous briefs to the Board within 15 days from the
date hereof discussing the legal implications of said opinion

respect to the instant complaint as well as all other legal
considerations inherent in this proceeding.
