OPINION and ORDER OF THE BOARD

The petitioner was before this Board in an earlier request
for variance which was granted subject to
a number of conditions
(PCB 71—163,
September
16,
1971).
The instant petition asks that
a repair completion date of the “middle of January”
be advanced
to March
15,
1972 and that Central Soya be allowed to operate
boilers No.
2 and No.
3 until that time without performing emission
rate tests.
The Environmental Protection Agency
(EPA)
in its Recommendation
expressed a concern that the boilers may be operating in violation of
the particulate regulations and further
the EPA stated that petitioner
had not complied with
a condition of our earlier order regarding the
control of SO2.
The extension of time requested in the variance petition has now
passed.
The request is moot and the petition is therefore and hereby
dismissed.
