HEARING OFFICER ORDER
On December 8, 2005, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it is still awaiting the permit. It is hopeful that
the permit will be issued prior to the next status conference and that a motion to voluntarily
dismiss this matter could then be filed. The parties made an oral motion to stay any rulings in
this matter, including the fully briefed and pending cross-motions for summary judgment. That
motion was granted. Rulings will be stayed through March 9, 2006.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on March 9, 2006, at 10:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
