The University petitions for permission to burn wood and
asphalt shingles from two demolished buildings on its Macomb
campus in order to save about
$1000
in alteEnative disposal costs.
In essence the University disagrees with. the open—burning reg-
ulations;
the hardship it alleges is not arbitrary and unreasonable
as required by the statute for a variance.
We think no purpose
would be served by a hearing, since even if the facts alleged were
proved we would not grant the variance.
The petition is dismissed.
Mr. Aldrich dissents, believing
a hearing should be held.
