ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter is before the Board on a petition for variance
extension,
filed by Amerock Corporation on August 21,
1992.
A
review of the petition, coupled with information furnished in
connection with Amerock’s earlier variance petition (PCB 87-131),
shows that Amerock has complied with all content requirements
except the following:
1.
A detailed description of the proposed method of
compliance
(see Section 104.121(f)).
Amerock states that if
the Board denies Amerock’s pending petition for a site—
specific rule (R87-33), Amerock “will further evaluate the
collection and treatment option and the source abatement
option to determine which of the alternate compliance plans
will be implemented.”
(Petition at 3.)
This statement does
not provide sufficient specificity for the Board to evaluate
Amerock’s chosen plan.
2.
Amerock has waived hearing in this matter.
However,
the petition does not contain an affidavit in support of the
material facts,
as required by Section 104.124.
3.
Amerock states that it incorporates the records of PCB
87-131 and R87—33 into this proceeding,
and will provide
copies of the pertinent portions of these records, to the
Board.
As provided in Section 101.106, Amerock must provide
four copies of the material to be incorporated.
Failure to remedy the above deficiencies within 45 days of
this order will subject the petition to dismissal.
IT IS SO ORDERED.
