FACTS
1.
That F. I. M., Inc. (“Respondent”) is the present owner and operatorof a facility located
at
600 South
Fifth Street, Quincy, Adams County, Illinois.
The property is commonly known to the
Illinois
Environmental Protection Agency as Quincy/F.I.M.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with
Site Code
No. 0010655009.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on February 24, 2005,
Michelle Cozadd of the Illinois Environmental Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-described
facility.
A
copy
of
her
inspection
report setting
forth
the
results
of said
inspection
is attached
hereto
and
made
a part
hereof.

VIOLATIONS
Based
upon direct observations made by Michelle Cozadd during the course of her February
24, 2005
inspection of the above-named facility, the Illinois
Environmental Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
0
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of the Act,
415
ILCS 5/2I(p)(1)
(2002).
CIVIL PENALTY
Pursuant to
Section
42(b)(4-5) of the Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent
is
subject
to
a
civil
penalty of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of the
violations
identified
above,
for
a total of
One Thousand
Five
Hundred
Dollars
($1,50000).
If
Respondent elects
not to
petition
the
Illinois
Pollution
Control
Board, the statutory civil
penalty
specified above shall be due and payable no later than May 15. 2005, unless otherwise provided by
order of the Illinois
Pollution Control
Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1
of the Act, 415
ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred by the
Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing
costs shall be assessed
in
addition
to the One Thousand
Five Hundred
Dollar ($1,500.00) statutory civil penalty for each
violation.

The purpose of this memorandum is to
serve as the narrative for a re-inspection conducted on
February 24, ‘2005 of the above referenced site.
The re-inspection took place from approximately
12:05 pm to
12:35 pm.
The weather conditions were cloudy and 32°Fwith light snow and wet
soil conditions.
Twenty-four digital photographs were taken to document the conditions ofthe
site.
No one was interviewed during the ~e-inspection. David Jansen, DLPC/FOS
Springfield
Region Manager, accompanied me.

The site was previously inspected on September 23, 2004.
An Open Dump
Administrative
Citation Warning Notice was sent to Mr. Thomas Freese on October 26, 2004.
A cleanup
deadline ofJanuary
1, 2005 was agreed to
in a November 9, 2004 response letter from Mr.
,Freese.

Upon arrival
at the site on February 24, 2005, I observed a small number of
changes
in the site
conditions since the initial inspection on September 23, 2004.
A trailer full ofscrap
metal on the
northeast side ofthe-site had been removed from the site.
In addition, two trailers full of scrap
metal, several piles ofstructural steel and other miscellaneOus scrap metal have been remoVed
from the northwe~t
portion ofthe site.
While progress has been made to remove the scrap metal~
from the property, the unidentified drums, the two roll-off boxes full of refuse and other waste
materials remain at the site.

shown in the attached photo #020.
‘Two full
roll-offboxes, scrap metal, unidentified drums
and waste materials were observed in this area.
The six unidentified drums observed during the initial inspection, which remain unChanged at the
site, are shown in the attached photo #001.
The used tires and one oftwo roll-offboxes are
shown in the attached photos #002 through
#005.
This roll-offbox appears to
contain the same
refuse as observed in the September 23, 2004 inspection with the addition ofa plastic
green
-
garbage can and a few pieces ofdamaged dimensional lumber.
There were around thirty used
tires piled near the roll-offbox.
The second roll-offbox
is shown in the attached photos #006
and #007.
This
roll-offbox also appeared
to contain the same refuse as noted during the

previous inspection as documented in the digital photographs.
.Scrap metal, damaged
dimensional lumber and other miscellaneous waste materials were scattered around the northwest

side of the site as shown in the attached photos #004 through #007.

Waste materials including wood pallets, damaged dimensional lumber, plastic sheeting, white
goods, unidentified containers; spills ofunidentified waste and other miscellaneous debris were
observed in the northeast portion of the site.
This area is illustrated in the attached photos #008

full,
closed blue plastic drums.
The drums were both labeled
as a plasticizer.
Two grain sorghum
bags on top ofthe blue’drums were deteriorating and the red colored sorghum had spilled on the
grourid. A close-up ofthe spilled material is
shown
in the attached photo #0 12.
Another spill ofa different white and black colored unidentified plastic-like material was
observed just
southwest ofthe blue drums as shown in the attached photos #014 through #017.
A close-up ofthe two weathered fiber drums is shown in the attached photo #015.
The drums,
spilled white material, wood pallets, plastic tubing, plastic rings and
other waste materials were
scattered on the ground in this
area.
A large cardboard box’ and ametal.grey tote were observed north ofthe white spilled material as
illustrated in the attached photo #0 18.
The hirge cardboard box was not observed in this location
during the September 23,
2004 inspection.
The contents of the box are shown in the attached
photo
#021.
The box contained some debris on
top ofa large quantity ofunidentified small
plastic-like pellets.
A dented grey metal tote
is shown in the attached photos #023, and #024.
The tote was full to
the top with a black used oil-like substance as shown in the attached #023.
It
was not labeled “Used Oil.”
This tote was also observed on the property during the September
23,
2004 inspection.

The response from Mr..Frese also included two letters from tenants concerning the drums inside
the warehouse.
‘In the first letter, Westmin Corporation explained that their possessions included
an undetennined amount of 55-gallon drums ofa useable zinc oxide product.
The Other letter
from AquaTech Marine stated that an unspecified amount ofused oil~
containers were present in
the warehouse.
The Agency’s December
8, 2004 letter to Mr. Frese required the submittal of
used oil manifests to
document the proper disposal or recycling ofthe used oil.
This office has
not received any manifests.
The used, oil containers
could not be inspected because the
warehouse was closed and locked during the February 24, 2005 inspection.

Copies of
manifests
and receipts that document the proper disposal
or recycling of all waste
materials at the site were to
be submitted to the Agency by January 5; 2005.
The Agency has not
received any of the required documentation for the removal of the scrap metal.
The:apparent
open dumping violations
that were cited during the initial inspection are continuing based on the
February 24, 2005 observations..
