HEARING OFFICER ORDER
On January 24, 2006, the parties participated in a telephone status conference with the
hearing officer. The parties jointly moved to stay all discovery deadlines in light of significant
progress made on the settlement negotiations. The parties report that there is a construction
deadline on March 31, 2006 that will have an impact on the settlement agreement, and the parties
will need additional time after that date to finalize the terms. The motion to stay discovery is
granted. At the next status conference, the parties will discuss whether settlement appears likely,
or whether the discovery scheduled will need to be reinstated.
The hearing officer has prepared an order ruling on the outstanding discovery motions.
However, since that order includes deadlines for discovery responses, the hearing officer will
hold off on issuing the order until it appears that settlement is unlikely, and discovery is
reinstated.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:30 a.m. on April 17, 2006. The status conference shall be initiated by the
complainant.
