BOARD

On
March 14,
1977 Petitioner herein filed its Motion for
Clarification of Board Order requesting clarification of the Board
Order issued herein on March
3, 1977.
On March
3,
1977 the Board, upon consideration of what Peti-
tioner purports
is an Alternative Petition for Permit Denial Appeal
and for Variance,
found that consideration of both petitions
in one
action would be incongruent due to the completely different subject
matter and burden of proof in these two actions.
Rather than reject
the Petition as a whole,
the Board, on its own Motion, construed
this submission as a Petition for Variance and so stated
in its
Order of March
3,
1977.
At this time, Petitioner has
a Petition
for Variance before the Board numbered PCB 77-9.
If
it desires to
pursue
a permit denial appeal before this Board,
it must do so
in
a separate Petition.
