reconsider its February

1982 Order insofar as that Order
dismissed Count VI of the December 2,
1982 Complaint.
No
response has been received.
The motion is granted.
As Count VI alleges violation of
Rule 314(D) which underlies Agency TPS 314(C,
D—4), the dismissal
of that Count is vacated.
The December 31, 1981 motion to dismiss
Counts
V, VI, and VII has accordingly been denied in its entirety,
