ORDER
OF THE BOARD

This matter comes before the Board upon
a motion filed
by the Environmental Protection Agency
(Agency) on April
9,
1979.
Petitioner,
Borden Chemical Company
(Borden) filed a
response to the Agency’s recommendation on its variance peti-
tion.
Borden’s response requested relief which the Agency
alleged differed from that
in its petition.
In this motion
the Agency asks that the response be deemed an amended peti-
tion and that it be afforded an opportunity to
file an amen-
ded recommendation.
The motion
is granted.
The Response is deemed an amen-
ded petition and the
90 day statutory period shall commence
as
of the date of its filing.
Borden shall have seven days
after the filing of the amended recommendation in which it
may file an amended response.
