ILLINOIS POLLUTION CONTROL BOARD
May
6,
1976
PEOPLE OF THE STATE OF ILLINOIS,
Complainant,
v.
)
PCB 76-6
JOHN TARXOWSKI,
Respondent.
ORDER OF THE BOARD
(by Mr. Goodman):
On April 19,
1976,
Respondent filed with the Board a Motion
to Strike Complainant’s Objection and a Motion for Summary Judg-
ment.
Respondent’s prayer for relief was divided into four para-
graphs to which the Board responds
as follows:
1.
Respondent’s
request
is rendered moot by a prior
Order of the Board issued today
in this matter.
2.
Respondent’s Motion for Summary Judgment did not
indicate on what basis such Judgment should be
granted by the Board and it is therefore denied.
3.
Respondent’s Motion to Dismiss the Complaint in
PCB 76-6 is not only too late under the Board
Procedural Rules but once again the Motion con-
tains nothing in support of such Motion.
Re-
spondent’s Notion to Dismiss is therefore denied.
4.
Respondent’s fourth request appears frivolous on its
face, but in any event such an Order is beyond the
authority of this Board.
IT IS SO ORDERED.
