The Environmental Protection Agency
(Agency) filed
on March
28,
1975
a Motion to Dismiss the Variance Petition
in
this matter.
In its Motion,
the Agency alleged that Petitioner,
Chicago Housing Authority, had
in fact
ceased operation of the facilities which are
the subject of
the Variance
Petition,
such action having been taken prior
to the expiration of
a prior
variance.
The Agency’s action
is
timely and proper.
The Petitioner,
on April
10,
1975,
filed a communication agreeing
with the Agency’s Motion.
We
will take this as
a request by Petitioner
that
its Petition be withdrawn.
The cause
is dismissed without prejudice.
