Petitioner has filed a motion asking for entry of an order
directing that the Agency file its recommendation within 21 days
from the date of the filing of the variance petition,
for leave
to file affidavits in support of its petition and for the 1’setting
of a hearing
to consider the necessity for a hearing”.
The Agency
is directed to file its recommendation within 21
days from the date of
the filing of the petition or by May 4, 1973.
On motion for good cause shown,
this time may be extended.
Petitioner!s motion for leave to file affidavits and other proofs
in support of its petition is granted.
The motion for hearing to
determine the necessity for hearing on the petition is denied.
The Board will determine whether the need for a hearing on the
petition is indicated upon receipt of the additional material to
be filed by petitioner and the Agency’s recommendation.
