1989, Laclede Steel Company
(“Laclede”)
filed a petition
for variance and a motion
to stay.
The motion
to stay was denied at
the Board’s December
20,
1989
Board
meeting.
Laclede
requests a variance from 35
Ill. Adm.
Code 728.150,
as
it applies
to Section 728.133, which was adopted
in R89—1,
effective November
27,
1989.
The Board found
the petition
to be
deficient,
and noted
that unless an amended petition was filed
within
45 days of the date of the December
20,
1989 Order, curing
the defects,
the matter would be subject
to dismissal.
The Board notes
that Laclede has not filed
its amended
petition for variance since
the December
20,
1989 Board Order.
It has now been over
60 days and no response has been received.
The Board,
on
its own motion,
will dismiss
this matter.
Laclede
is free to file
a new and ~p~jj~
RCRA variance petition,
if
it
so chooses.
