Sangamo Construction Company has moved for stay of the

portion of our Order entered in the above-captioned case requiring

the payment of a penalty of $5,000 pending appeal by Respondent

to the Appellate Court of the State of Illinois,

4th District.

As we have held in previous cases,

no useful purpose would be

served by insisting on the payment of the penalty, which. in the

event of reversal, would be required to be returned to Respondent

and accordingly,

the Respondent’s Motion for Stay of our order with

respect to the penalty of $5,000 is granted,

pending judicial

review of this proceeding.
