On November 26 and December 20, 1979 Central Illinois
Public Service
(CIPS)
filed motions
to stay NPDES permit condi~
tions
for two plants:
Grand Tower Power Station and Hutsonville
Power Station.
The contested conditions involve pretreatment,
prior to discharge into an ash pond~of boiler chemical cleaning
wastes which are generated only when the boilers are cleaned
every two or three years.
Cleaning is scheduled for Grand Tower
in May,
1980 and Hutsonville in March, 1980.
Petitioner
alleges
that pretreatment plants cannot be built in time to allow clean~
ing of these boilers as scheduled and that
it is unlikely the
hearings will be concluded in time for decision prior to the
scheduled cleanings.
On December 12 and 24 the Environmental
Protection Agency
(Agency)
filed objections
to the motions
to
stay.
These are renewed permits and the contested provisions
are new.
The Agency has not pointed to regulations which require
it to include the contested conditions,
Since they appear to be
new discretionary conditions the motions to stay will be granted.
