ORDER OF THE BOARD

The parties have filed Joint Motion
for Extension of Time
Within Which to File Report and Recommendations with the Board.
They state that they have completed their testing program and
compilation of data but need additional time
to draw final con-
clusions and negotiate a final settlement.
We shall allow the
additional time for submitting proposal for a final settlement
and for submitting reports of stack analysis, stack emission
measurements, ground level measurements and other odor testing.
However, the Joint Motion also requests extension of variance.
The variance request fails
to give basic information or comply in
any way with our Procedural Rule 401.
The Petition for extension
of variance is therefore inadequate and will be dismissed without
prejudice.
It is Ordered that the proposal for final settlement (para-
graph
6 of our November 8,
1972 Order)
shall be submitted by
January 15,
1974 or
a hearing shall be held for determination of
the issues.
The reports of stack analysis,
stack emission
measurements, ground level measurements and other odor testing
(paragraph
7 of the Board Order of November
8,
1972)
shall be
filed with the Pollution Control Board by January 15,
1974.
The
Petition for Variance Extension is dismissed without prejudice.
Mr. Marder abstained.
