HEARING OFFICER ORDER
On September 29, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that offers and counter-offers continue to be exchanged.
At issue is a supplemental environmental project, which the Illinois Environmental Protection
Agency recently received additional information from the respondent. By agreement,
complainant is directed to file its response to the respondent’s affirmative defenses on or before
December 23, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 23, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
