ORDER OF THE BOARD
(by Mr. Goodman):
On November 18,
1976,
Respondent John Tarkowski filed
a Motion
Instanter to Reconsider and Vacate and Set Aside
the Board’s
November 10,
1976 Opinion and Order in the above-captioned matter.
Based upon Mr.
Tarkowski’s statement in his motion that he receives
$290.00
a month from Social Security disability and does not have
the funds
to pay the assessed penalty,
the Board will amend its
prior Order by suspending the assessed $75.00 penalty.
Mr. Tarkowski
has otherwise submitted no new information which would warrant
reconsideration of the Board’s Order.
Mr. Tarkowski’s motion
is,
therefore,
denied, except to the extent of the above—mentioned amend-
ment suspending the penalty.
