HEARING OFFICER ORDER

On July 21, 2005, both petitioner Waste Management of Illinois Inc. (WMII) and the

respondent County of Kankakee (County) contacted the hearing officer regarding an extension of

time to file their respective and outstanding post-hearing briefs.

WMII represented that it will file a waiver of the statutory decision deadline to and

including November 17, 2005. In light of the additional waiver, the parties requested that the

post-hearing briefing schedule be extended as well. The parties’ request is granted. To that end,

the County’s post-hearing brief is now due to be filed on or before September 22, 2005. WMII

reply brief, if any, is due to be filed on or before October 5, 2005. The mailbox rule does not

apply.
