HEARING OFFICER ORDER
On March 16, 2006, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that it appears they have reached a settlement
and a stipulation and proposal for settlement (stipulation) is being circulated for review
and for signatures. Respondent is given to April 28, 2006, to replead its affirmative
defense to
laches
, if needed, and the complainant is given to May 12, 2006, to answer
respondent’s affirmative defense number 2 not addressed in the Board order of March 4,
2004, if needed.
The parties are directed to participate in a telephonic status conference with the
hearing officer on April 27, 2006, at 9:00 a.m. The status conference must be initiated by
the complainant, but each party is nonetheless responsible for their own appearance. At
the status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing. If, however, a stipulation is filed prior
to the next status conference, the conference will be cancelled without further order.
