Petitioner filed
a Motion for Stay from Part
1 of the
Noise Regulations
(R72-2)
on April 16,
1974.
The Environmental Protection Agency filed a Response on
April
22,
1974.
The Board requested the parties
to furnish suggested
Final Orders on May 22.
Both parties submitted proposed Final
Orders.
The Board has decided to deny the Motion for Stay because
it does not believe Petitioner as demonstrated that
it
is entitled
to
a complete stay of Part
1, as~itwas requested.
The Environmental Protection Agency stated that it had
had no objection to granting
of
a limited stay,
limited to
a
short period of time
after the filing by the Board of its
Brief in the Appellate Court hearing
Petitioner’s appeal.
Petitioner stated on page
3
of its Answer
to the Agency response
that it did not want such
a limited Stay.
The
Board hereby denies Petitioner’s Motion
for Stay.
IT IS SO ORDERED.
