HEARING OFFICER ORDER
On June 8, 2006, all parties participated in a telephonic status conference. The
petitioner’s motion for extension of time to file a response, filed May 30, 2006, to respondent’s
motion for summary judgment was discussed. The petitioner orally amended its request for an
extension of time so that it can review the remaining file. Petitioner represented that it intends to
procure the remaining file pursuant to the Freedom of Information Act. To that end, and without
objection from the respondent, petitioner’s response to the respondent’s motion for summary
judgment is now due to be filed on or before August 10, 2006. The due date of petitioner’s
response may need to be revisited at the next status conference. Petitioner represented that it
will file a 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 3, 2006, at 10:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
