ORDER OF THE BOARD (by J. Yi):
On October 17, 1997, PDV Midwest Refining, L.L.C. (PDV) filed a petition seeking
to amend and renew a previously granted site specific rule. PDV owns a petroleum refinery
located in Will County near Lemont, Illinois. The refinery was formerly owned and operated
by the Union Oil Company of California (Union) and then operated by the UNO-VEN
Company (UNO-VEN). The Board granted a site specific rule change to Union in 1987; see
In the Matter of: Proposal of Union Oil Company of California to Amend the Water Pollution
Regulations: 35 Ill. Adm. Code 304.213 (March 19, 1987), R84-13. The Board amended and
renewed this rule in 1993; see In the Matter of: Petition of UNO-VEN to Amend Regulations
Pertaining to Water Pollution: 35 Ill. Adm. Code 304.213 (December 16, 1993), R93-8.
PDV became the owner of the refinery on May 1, 1997, and is seeking to amend and renew
the site specific rule pertaining to water discharged from the refinery. The petition meets the
information requirements of 35 Ill. Adm. Code 102.121 and 102.141 and is accepted for
hearing.
The proponent filed two motions with the petition. The first asks that the Board waive
the requirement that a proposal for rulemaking be accompanied by a petition with at least 200
signatures. See 415 ILCS 5/28(a) (1996) and 35 Ill. Adm. Code 102.141(c) citing
102.121(h). The motion notes that PDV employs approximately 650 people, and produces 25
different products at the refinery. The filing of this petition is in the public interest, and the
Board hereby grants the motion to waive the signature requirement. In the second motion,
PDV requests that the Board waive the requirement that a petition be accompanied by nine
copies of all exhibits. See 35 Ill. Adm. Cod 102.140. The second motion states that the
exhibits to the petition consist of technical reports that are substantial, each having over 100
pages of text, figures, and data. The Board grants this motion, and will allow PDV to file
only four copies of the exhibits to the petition.
