In support ofthis motion,
Petitioner states as follows:
1.
Bunker
Hill Amoco
(“Petitioner”),
on the same date that this
motion was
filed,
filed a
Petition to
the Illinois
Pollution
Control Board to
appeal
an
Agency
decision dated July 23,
2004,
denying a High Priority Corrective
Action Plan
Budget that was submitted
to
the Agency.
The Agency had
approved
the
work
to
be
performed
in
the
amended
High
Priority
Corrective Action Work
Plan.
2.
The Agency’s letter denying the Budget provided as a reason for denying
the
Budget
that
costs
exceeded
the
Agency’s
“statewide
observations.”
(See
Exhibit
1.)
The Agency is using its “statewide observations” as a rule
and,
because
the
“statewide
observations”
have
not
been
properly

a rule pursuant
to
the
Illinois
Administrative
Procedures
Act
(5
ILCS

et.
seq,
(2002)),
the
“statewide observations” are
an
invalid
rule.

where
the
Board
found
that
the
Agency’s
use
of a
rate
sheet was an invalid rule.

In addition, the Agency recently has begun to require cost comparisons for
various costs.
These cost comparisons were first proposed to the Board in
the
rulemaking
proceeding
to
amend
the
underground
storage
tank
regulations,
R04-22
and
R04-23,
on
August
2,
2004,
after
IEPA
began
requiring cost comparisons.
The requirement for a cost
comparison is
an
invalid rule.

Further,
the Agency, on
April
19,
2004, proposed to the Board emergency
rules
to
use because the
Agency
claimed
it could
no
longer use its
rates
sheets.
The
proposed
emergency rules
were
identical
to
the
rules
the
Agency
initially
proposed
in
R04-22
and
R04-23,
and
numerous
stakeholders, including CW3M, Bunker Hill Amoco’s consultant, objected
to
the
proposed
emergency
rules.
Subsequently,
amended
emergency
rules
were
proposed.
On June
3,
2004,
the
Board
denied the
Agency’s
Motion for the Adoption of Emergency Rules and
stated:
Prior to
the Agency’s use ofthe rate
sheet, the Agency processed
reimbursement and
budget requests
and
the
UST
Fund
survived.

legitimate
concerns,
but
do
not
constitute a
threat
to the public interest,
safety or welfare.

Numerous
hearings have been held in
R04-22
and R04-23
during which
testimony
against some of the proposed rules has been presented.

Even
so,
the Agency is trying to use the proposed. rules and requirements
even before proposing them to
the Board and to use other invalid
rules to
make final decisions.
7.
Petitioner
is
requesting
an
expedited hearing in
this
matter
because
the
Agency is
continuing to
use invalid rules to make decisions and requiring
that
additional
procedures
be
followed
without providing any
advanced
notice
of such requirements,
all
of which
result in
material
prejudice to
petitioner.
8.
The Agency’s illegal
actions are damaging Petitioner because the Agency
has refused to
approve the Petitioner’s
Budget as submitted and continues
to request additional
information,
even though
the
Agency
has approved
similar budgets with similar documentation,, historically.

Amoco

owner
of a
gasoline
service
station
located at
206
South
Washington
Street, Bunker
Hill, Macoupin
County,
Illinois
(the
“Station”).
This
gasoline
service
station
had
underground storage tanks (UST’s) on the property, which stored
gasoline
and diesel fuel.
2.
LUST
Incident
Number
982437
was
obtained
following
a
site
investigation.
The
site
has
also
been
assigned
LPC
#1170105009-
Macoupin County.

On May 17,
2004,
Bunker Hill Amoco
sent to
the Agency
an
amendment
to
the
High
Priority Corrective Action Plan
and High
Priority Corrective
Action
Plan
Budget
to
perform
corrective
action
at
the
Station.

The
Agency
received
these
documents on May 19, 2004.
The Budget included signed certifications to
the
effect
that
the
submitted
Budget
complied

Environmental
Protection Act.

July
23,
2004,
the Agency
sent
a
letter
to
Petitioner
approving
the
amendment to
the
High
Priority Corrective Action Plan
and
rejecting the
High
Priority
Corrective Action Plan
Budget (the “Budget”).
The letter
listed additional information required by the Agency.

Exhibit 2.)

Bunker Hill Amoco
appeals the Agency’s denial ofthe Budget as set forth
in the Agency’s July 23, 2004, letter (the
“Letter”).

The Letter, among other things,
states that “the owner or operator has not.
provided
documentation
(justification)
for the
number of personnel
and
the number of personnel hours required to
complete the corrective action.”

Exhibit

Attachment
A,
point

paragraph.)
However,
the
Budget does document the number ofpersonnel
and hours and the Agency
has accepted this same level ofdetail
historically.

The Letter also states:
The
owner
or
operator shall
also
provide
documentation
for the
excavation, transportation, disposal
and backfill costs.
These costs
differ greatly from the Illinois EPA’s
statewide observations.

The Budget
provides
these
costs
and
gives
the
same
level
of detail
for
these costs that the Agency has approved historically.

Historically,
the Agency has approved similar costs in other budgets.

The Agency’s requirement for a cost comparison was used by the Agency
to
make
a
final

decision
and
because
this
requirement
has
not
been
promulgated
as
a
rule
through
a
rulemaking
proceeding
in
compliance
with the APA, this requirement is an
invalid rule.

The
Agency’s
letter provides
no
additional
information
regarding
why
JEPA disapproved the Budget while it approved the work to
be done in the
amended High Priority Corrective Action Plan.
WHEREFORE, Bunker
Hill Amoco respectfully requests that the Board enter an
order requiring the Agency
to
approve the High Priority Corrective Action Plan
Budget
to
allow
Bunker
Hill
Amoco
to
cover
the
costs
of the
cleanup
at this
facility and
for
Bunker Hill Amoco’s attorneys’ fees and
costs in bringing this appeal.

One
of the overall
goals of the financial review is to
assure that the
costs are adequately
documented.
Costs that lack suppohing documentation
are not eligible for payment from
the Underground Storage- Tank Fund because the Illinois EPA cannot determine whether
the costs will be used
for activities
in excess of those necessary to meet the minimum
requirements
of the Illinois Environmental Protection Act.
The amendment to the High Priority Corrective Action Plan Budget
contains costs that
are not adequately documented; therefore, the Illinois EPA cannot
determine whether the
costs proposed in the amendment will be used for activities in excess of those necessary
to meet the minimum requirements of the Illinois Environmental Protection Act.
Specifically,
the owner or operator has not provided
documentation
(justif cation)
for the
number
ofpersonnel and the number ofpersonnel hours required to complete the
-
corrective action.
In
addition, the owner or operator has not provided
documentation
(justification) for the excavation, transportation, disposal
and backfill
costs (field
purchases
and other costs).
-
-The owner
or operator shall explain why an
environmental engineer,
an engineering
technician and a field
supervisor/coordinator need to be on-site during the excavation and
backfilling activities.
The owner or operator shall also provide documentation for the
excavation, transportation, disposal and backfill
costs.
These
costs
differ greatly from
the Illinois EPA’s statewide observations.
The owner or operator shall compare the cost
fordifferent backfill materials
and different suppliers.
2.
The amendment to the High Priority Corrective Action Plan Budget contains handling
charges that
are not eligible for payment from the Underground Storage Tank Fund.
Specifically, handling charges
associated with the Water Pollution
Control Permit Fee are
not eligible for payment from
the Underground
Storage Tank Fund.

An underground
storage tank owner
or operator may appeal
this final
decision to the Illinois
Pollution Control Board pursuant
to
Sections 40
and 57.7(c)(4)(D)
of the Act by filing a petition
for a hearing within-35 days after the date of issuance of the
final decision; however, the 35-day
period
may be
extended for a period of time not to exceed
90 days by written notice from the
owner or operator and the Illinois EPA within the initial 35-day appeal period.
If the owner or
operator wishes to receive a 90-day extension, a written request that includes .a statement of the
date the
final decision was received,
along with
a copy of this decision,
must be sent to
the
Illinois EPA as soon as possible.
