HEARING OFFICER ORDER
On March 9, 2006, all parties participated in a telephonic status conference with
the hearing officer. On March 3, 2006, the respondent filed a belated response to
complainant’s motion to deem facts admitted and a belated amended response to request
for admission of facts. The respondent made an oral motion for extension of time to file
both belated pleadings
instanter.
The complainant had no objection to the belated filing
of respondent’s response to complainant’s motion to deem facts admitted. The
respondent’s motion for extension of time as to its response to complainant’s motion to
deem facts admitted was granted.
Complainant, however, objected to respondent’s oral motion for extension of time
as to its amended response to request for admission of facts. The respondent was
directed to file a written motion for extension of time addressing its belated filing of it
amended response. Respondent’s motion is due to be filed on or before March 16, 2006.
The parties were directed to file a proposed discovery schedule on or before
March 17, 2006.
Finally, the respondent represented that it has still attempting to gather and
forward to the complainant additional financial information.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on May 18, 2006, 11;00 a.m. The telephonic
status conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be
prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
