IT IS THE ORDER of the Pollution Control Board that the Com-
plaint
in this matter,
filed October 8,
1974,
is hereby dismissed
as premature.
Complainant
is asking the Board to restrain the future construct-
ion of a 190 condominium planned unit development.
The proper course
for complaints
to take
is through the permit program of the Illinois
Environmental Protection Agency~ Respondent must apply to the Agen-
cy for construction
permits
before bui1ding~the project could be
started.
If at that time,
the Agency issues a permit for the con-
struction of the project, Complainants can file under Rule 503 of
the Board’s Procedural Rules to appeal the issuance of the permit.
