    On October

    1974,
    the Illinois Environmental Protection
    Agency
    (Agency)
    filed with the Illinois Pollution Control Board
    (Board)
    a Motion for Clarification and Reconsideration of the
    Interim Board Order of August
    8,
    1974,
    in the above—entitled matter.
    The Agency specifically requested a clarification concerning con-
    struction permit requirements in relation to the date that operating
    permits
    are
    required.
    During
    the
    R72-18
    proceeding
    in
    1973
    the
    Board
    established
    September
    1,
    1974,
    as
    the
    date
    by
    which
    operating
    permits
    were
    required for grain handling and conditioning operations
    (8 PCB 307
    and
    9 PCB 47-49).
    This date was extended beyond September
    1,
    1974,
    pending review and final
    action in the R72-l8, which is expected
    soon.
    Although dates for operating permits were dealt with in the
    Interim Board Orders of 1973
    (June
    15 and August
    9)
    and August
    8,
    1974, construction permits were not mentioned specifically.
    This
    was an oversight.
    Since R72-l8 regulations have not been promulgated,
    standards
    are not available to use in evaluating construction permit applica-
    tions.
    Therefore, the construction permit requirements under Rule
    103(a) (1)
    of Chapter
    2, Air Pollution Regulations,
    are hereby sus-
    pended
    as
    they apply to grain handling and conditioning operations
    which are the subject of the current R72—18 proceeding.
    The date
    on which construction permit requirements for such facilities will
    be reinstated will be determined by subsequent Board action
    in
    the
    current R72-18 proceeding,
    as will operating permit requirements
    according to our Interim Order of August 8,
    1974.
    Although construction permit requirements are temporarily
    delayed
    until
    the R72-18 is finalized,
    anyone who constructs
    a
    grain handling facility in the interim should first carefully review
    and evaluate the proposed grain handling regulations to minimize the
    possibility of unnecessary expense or effort.

    IS
    THE
    ORDER of the Illinois Pollution Control Board that
    construction permit requirements under Rule 103(a) (1)
    of Chapter 2,
    Air Pollution Regulations,
    are hereby suspended as they apply to
    grain handling and conditioning operations which are the subject of
    the current R72-18 proceeding, and that they will be determined by
    subsequent Board action in the R72—18 proceeding.
