    ORDER OF THE BOARD (by C.A. Manning):
    This order vacates the December 7, 2000 order, which granted an extension of time to
    file a permit appeal to January 25, 2001. On December 28, 2000, IBP, Inc. (IBP) filed a
    motion for clarification of the December 7, 2000 order.
    The parties agreed to extend the normal 35-day appeal period for a period of 90 days to
    and including March 1, 2001, which is the 125th day following the Illinois Environmental
    Protection Agency’s (Agency) permit issuance on October 27, 2000.
    On December 7, 2000, the Board issued its order granting an extension of the time to
    file a permit appeal to January 25, 2001, which is a total of 90 days following the Agency’s
    permit action.
    In this case, IBP and the Agency agreed to an extension for 90 days to and including
    the 125th day following the Agency’s permit action, that is, March 1, 2001. Given that
    agreement, the Board vacates its December 7, 2000 order and grants an extension of the time
    to file a permit appeal to March 1, 2001.
    The Board will dismiss this matter and close the docket if petitioner fails to file an
    appeal on or before that date.
