The company first petitioned
(#71-79)
for permission
to conduct
open burning
for
the purpose of instruction in firefighting
techniques on April
27, 197l~
Since the petition was filed April
19,
there was
no time for us to pass on it;
a second petition
(#71-96)
superseded
the first and changed the date to July
8.
As we have
done in past cases
(see Deere
& CoW,
v.
EPA,
#70-20,
DecO
22,
1970),
we grant the petition subject to conditions suggested by the
Agency,
recognizing that there is no substitute for firefighting
in learning to fight fires
and that the benefits
of such instruction
far outweigh the little pollution it causes under proper conditions.
I.
American Steel Foundries is granted
a variance
to permit
open burning on any one
day during July,
1971 for the purpose of
instruction
in lirefighting techniques on its plant grounds on Granite
City subject to
the following conditions:
I)
burning shall be conducted only when the
wind
is from the east or west; only when the wind
speed
is
5
to
20 miles per hour;
only when
the
sky
is not overcast; and only between the hours
of
10
a,rn,
and
5 p~m.
2)
burning shall he limited to
10 gallons
of
#2
diesel oil
and 100 pounds of wood.
3)
the company shall file
a report of the burting with
the Agency within one month after the session.
The
report shall describe wind conditions,
the number of
employees attending,
the types
and amounts of conβ
hustibles burned,
and the total duration of burning
and smoke emission.
