That Bill Weis (“Respondent”) is the present operator of a facility located on Route
157
adjacent to 239 S
88th
Street,
Centreville, St. Clair County,
Illinois.
The property is commonly
known to the Illinois Environmental
Protection Agency as Centreville/Weis.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with Site Code
No.
1630305017.
3.
That Respondent has operated
said facility at all times pertinent hereto..
4.
That
on
May
12,
2004,
Christopher
Cahnovsky
of
the
Illinois
Environmental
Protection
Agency’s Collinsville
Regional Office inspected the above-described facility.
A copy of
his inspection report setting forth the results of said
inspection is attached hereto
and made a part
hereof.
VIOLATIONS
Based
upon direct observations made by Christopher Cahnovsky during the course of his
May
12,
2004 inspection
of the above-named facility,
the Illinois Environmental Protection Agency
has determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter,
the “Act”) as follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1) of
the Act,
415
ILCS
5/21(p)(1)
(2002).
(2)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
open
burning,
a
violation
of
Section 2l(p)(3)
of
the
Act,
415
ILCS
5/21 (p)(3)
(2002).
(3)
That
Respondent caused
or
allowed the
open
dumping
of
waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction or demolition debris, a violation of Section 21 (p)(7) of the Act,415 ILCS
5/21 (p)(7) (2002).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5) of the
Act, 415
ILCS 5/42(b)(4-5)
(2002),
Respondeni
is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for
a total of
Four Thousand
Five
Hundred
Dollars
($4,500.00).
If
Respondent elects
not
to
petition
the Illinois
Pollution
Control
Board, the statutory
civil penalty
specified above shall be due and payable no later than July15, 2004, unless otherwise provided by
order of the Illinois
Pollution
Control Board.

If Respondent elects to contestthis Administrative Citation by petitioningthe Illinois Pollution

in accordance with Section 31.1

issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing
costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in

Hundred
Dollar ($1,500.00) statutory civil
penalty for each
violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002), if Respondent fails
to petition or elects not to
petition the Illinois Pollution Control Board for reviewof this Administrative

On May 12,
2004, John Senjan, Jay Balmer and I conducted an inspection at a parcel of
property on Route
157 adjacent to
239
S
88th
Street Centreville, Illinois.
According to
St.
Clair County Records, this
property is
owned by RELMSS Service, Inc. Brooklyn,
Illinois.
Mr. Bill Weis, owner ofGateway Motor Company and
operator ofthis
site
where the dumping is occurring was not present during this inspection.
I spoke with Mr.
Weis telephonically about this inspection.
Mr. Weis stated that he is the owner ofdump
area and is in partnership with RELMSS Service, Inc.
The weather during this inspection
was warm about 80 Fahrenheit, the soil
conditions were
dry and it started raining during
this inspection.
No
one was present during this inspection
Site History
On April 29,
2003, the Illinois EPA conducted an inspection of this site.
During this
inspection the Agency noted that general C&D debris consisting ofbrick, concrete,
concrete with protruding rebar, metal, wire, asphalt roofing, wood waste, siding and
electrical conduit had been open dumped.
Apparently, D&S Wrecking had exclusive
rights to dump at this site.
Mr. Weis charged D&S $20.09 per load to dump.
Administrative Citation Warning Notices were
sent to both D&S Wrecking and Mr.
Bill
Weis on May 30, 2003.
On September 17,
2003, the IEPA conducted a follow up
inspection and determined that only clean construction and demolition debris was being
used at this
site.
According to receipts submitted by D&S Wrecking,
102.98 tons of
waste were removed from this site and taken to Roxana Landfill.
On May 12,
2004, I arrived on site about 13:30 hrs.
I entered the site through an open
cable gate.
No one was present.
I observed several hundred-truck loads ofconstruction
and demolition waste on the surface ofthis site.
This site is a low land that is being filled
in by Mr. Weis.
I observed several loads of general construction and demolition debris.
This waste consists ofrock, brick, dirt, metal, roofing,
dry wall, wpod, bed frames,
two
tires, concrete with protruding rebar, carpet, clothing and asphalt roofing.
In one area, I
observed that
a large amount ofgeneral construction and demolition debris mixed with
household waste had been burned.
Late in the day, I spoke with the property owner, Mr. Bill Weis.
Mr. Weis was aware
that the site is getting waste dumped on it and that he needs to
get it cleaned up.
Per Mr.
Weis, someone dumped on a Sunday and burned the waste.
I asked who was using the
site and if D&S
still had exclusive rights to
the site.
He stated that many different
companies are using the site now to
dump and that the material D&S dumps is
clean.

On May 18, 2004, I contacted Sonia Brooks with D&S Wrecking.
According to Ms.
Brooks, D&S stopped using the site on April 30, 2004.
They had two jobs going to
that
site, Dunbar School and
a Clinton Countyjob.
She stated that Mr. Weis charged them
$20.00 per load to dump
and they only took clean brick to the
site.
It appears that Mr. Weis is in apparent violation of the Illinois Environmental Protection
Act for causing or allowing the open dumping ofwaste at this site.
Mr. Weis must:
1.
Immediately cease all
open dumping and open burning at this site.
2.
Do not dispose ofany waste by open burning.
3.
All tires must be disposed of at a registered tire disposal site.
4.
Removal all waste to a permitted landfill or transfer station.
5.
Remove all landscape waste to
a permitted compost facility.
Landscaper
waste cannot be taken to a permitted landfill or transfer station for disposal.
6.
All disposal receipts must be submitted to the Illinois EPA to verify proper
disposal.

Protection Agency and has been so employed
at all times pertinent hereto.

On May 12, 2004, between 13:30 and
14:00, Affiant conducted an
inspection ofthe open dump in St.
Clair County, Illinois, known as
Centerville/Weis, Illinois Environmental Protection Agency Site No.
1630305017.
3.
Affiant inspected
said Centerville/Weis open dump by,an on-site
inspection which included walking the site and taking photographs.
4.
As a result ofthe activities referred to in Paragraph 3
above, Affiant assisted in
the completion ofthe Inspection Report form attached hereto and made a part
hereof, which, to the best ofthe Affiant’s knowledge and belief, is
an accurate
representation ofAffiant’s observation and factual conclusions with respect to
