BOARD
(by Mr.
Goodman):
On January
16,
1979,
the Board received
a letter signed by David Lippold,
Concerned Citizens Committee,
requesting that the Board reconsider
its deci-
sion in this matter based upon the allegation that
Kent Shodeen deceived the
Board in his petition for variance.
The Board rendered its decision in this
matter in September,
1978, after a full hearing in which all
interested citi-
zens had
the right
to
participate.
The proper time
to raise the allegations
in Mr.
Lippold’s letter would have been at
the hearing.
The Board
finds that
it
is inapproporiate
to
reconsider a decision based upon factual questions
raised for the first
time in a letter filed four months after the decision was
rendered.
The request
for reconsideration is denied.
