On February 17,

1977,

this Board, on Notion of Petitioner,

dismissed the instant case.

On February 22,

1977,

Intervenor Village

of

Richton Park filed

a Motion in Opposition to Petitioner’s Motion

to Dismiss.

In that Motion Intervenors reiterated their position

that Petitioner’s permit,

as granted by Respondent,

is not valid,

and that the validity of said permits has not been finally adjudi-

cated.

Intervenor has failed

to show how such issues were ever

properly before the Board in the instant case.

Because it was not

timely

filed, we treat Intervenor’s motion

as one for reconsideration

of

our February

17,

1977 dismissal Order, and deny it.
