ORDER OF THE BOARD
(by J. Anderson):
On August 13,
1981 the Hearing Officer requested the Board to
enter an Order to expedite scheduling and holding of hearing in
this matter which has been on the Board’s docket since September,
1979.
On August 19, 1981, Continental Grain responded that an
Order was unnecessary, as discovery in the actions was proceeding,
albeit after some delay caused by the death of a principal Agency
witness and a change of counsel representing the Agency.
On
September
1,
1981 the Agency also opposed the request.
Rather than ordering that hearing be held by a date certain,
the Board directs that an expeditious schedule for the completion
of discovery and the holding of hearings in this action be
established.
The Hearing Officer may renew his request for a
Board Order
if necessary.
