    ORDER OF THE BOARD (by G.T. Girard):
     
    On September 1, 2005, at the parties’ request, the Board extended until November 28,
    2005, the time period for Beverly Bank to appeal a July 20, 2005 determination of the Illinois
    Environmental Protection Agency (Agency).

    415 ILCS 5/40(a)(1) (2004); 35 Ill. Adm. Code
    101.300(b), 105.402, 105.406. The Agency rejected the site investigation plan for Beverly
    Bank’s leaking underground petroleum storage tank facility located at 10258 South Western
    Avenue, Chicago, Cook County. Because petitioner failed to timely file an appeal, the Board
    dismisses this case and closes the docket.
     
    IT IS SO ORDERED.
