ORDER OF THE
BOARD
(by Mr. Goodman):
This matter comes before the Pollution Control Board
(Board)
upon Respondent’s November 21, 1975, Motion ~toVacate
the Board Order, herein, of October 16, 1975 and allow Respondent
to file its Closing Arguments.
On September 18,
1975, the
Board entered its Opinion and Order in this cause.
The
Board
stayed enforcement pursuant to Respondent’s motion on September
29, 1975.
At that time the record was opened to allow Respondent
to file its Closing Argument.
Although the Board in its September
29 order granted the Respondent eight days in which to file
its Argument, the Record remained open until October 16, 1975.
At that time Respondent had still failed to file its Closing
Argument.
Over one month later, Respondent once again seeks
to open the record.
The Board feels that it has provided ample
opportunity of Respondent to file its Closing Argument and
therefore it is the Order of the Board that Respondent’s
Motion to Vacate be and is,
hereby, denied.
