ORDER OF THE BOARD
(by Mr. Henss)
Complainant has filed Motion to Amend Complaint
requesting leave to amend Count
II of the Complaint by
adding certain language to the “Wherefore clause”.
The
Motion
is denied.
Count II has been stricken and there
is nothing remaining before us to which such an amend-
ment could attach.
If Complainant wishes to revise its
theory of
the case with reference to Count II the
appropriate method is
to request leave for the filing
of an entire amended Count II.
It is ordered that the Motion to Amend Complaint
be denied.
