    This matter is before the Board pursuant to a status report
    and motion to defer proceedings filed on July 7,
    1995.

    defer

    rulemaking
    an
    additional 90 days so that petitioner may pursue settlement
    agreement with the Agency regarding the issuance of an NPDES
    permit.
    The statue report
    iB accepted and the motion to defer is
    granted.
    The next status report will be due on or before October

    1995.
