This matter comes before the Board on a petition filed on

February

18,

1992.

On April

12,

1993,

the parties filed

a

joint

status report pursuant

to a February

25,

1993 Board order.

The

parties report that they are negotiating the documentation Safety-

Kleen must

submit to

resolve this matter.

In February

of

1993,

Safety-Kleen

provided

comments

to

Agency

regarding

the

documentation.

In March of 1993, the Agency provided Safety—Kleen

with a draft closure plan.

On April 7,

1993, Safety-Kleen provided

the Agency with comments regarding the closure plan.

The Agency is

expected to complete its review of the comments within the next few

weeks.

The parties

are negotiating

the

terms

of

the plan

and

believe that agreement on these issues will represent

a significant

step towards

resolution

of this

matter.

The parties

anticipate

that

Safety-Kleen

will

soon

be

in

a

position

to

voluntarily

withdraw its appeal.

The parties are directed to file another status report on or

before July 29,

1993,

concerning the status of this matter.
