OPINION AND ORDER OF THE BOARD
(by Mr, Dumelle):
On November
8,
1973, Petitioner filed
a Variance
Petition from Rule 3~3~l1lof the Rules and Regulations
Governing the Control of Air Pollution and Rule 203(a)
of
the Air Pol.lution Regulations~ Petitioner seeks these
variances until February 28,
1974,
The Agency filed a
recommendation to grant the variance on January
29,
1974.
Petitioner has installed an emission control system
to eliminate particulate matter, which was designed by
Combustion Engineering Associates,
Inc.
(CEA)~ A design
error by CEA, necessitates the replacement of
a large motor
and modification~of
a portion of the baghouse filter system~
The Board finds that this delay was not caused by Petitioner
and will result in limited particulate emissions~ The
control system is currently operable and will achieve a
99,9
reduction
in. particulate emissions once the corrections
are
made,
The
above
consists
of
the
Board~s
findings
of
fact
and
conclusions
of
law.
The
Board
hereby
grants
Petitioner
a
variance
from
Rules

203(a)
until
February
28,
