On August 24,

1994, the Village of Creve Coeur filed a

petition seeking a water well setback exception pursuant to

Section 14.2(c) of the Environmental Protection Act (415 ILCS

5/14.2

(1992))

and 35

Ill. Adm. Code 106.601 et seq.

This matter

is accepted for hearing.

The Board notes that the property owner of the well is the

same as the petitioner in this matter; therefore,

only the

Illinois Environmental Protection Agency will be the respondent

to this petition.

The hearing must be scheduled and completed in a timely

manner, and will be conducted in accordance with 35 Ill. Adm.

Code 102.Subpart J.

The Board will assign

a hearing officer to

conduct hearings consistent with this order,

and the Clerk of the

Board shall promptly issue appropriate directions to that hearing

officer.
