    Pursuant to
    35 Iii. Adm. Code 104.180(a), after the Agency investigates a
    variance petition,
    it is required to make its recommendation to
    the Board on the disposition of the petition within 30 days after
    the filing of the petition.
    Major
    & Sandhu Petroleum,
    Inc. filed
    the Petition for Variance on October 31,
    1994.
    The
    recommendation was therefore due to be filed by the Agency on
    November
    30,
    1994.
    On
    December
    1,
    1994,
    the
    Agency
    filed
    a
    motion
    for
    extension
    of
    time,
    requesting
    until
    December
    14,
    1994
    to
    file
    its
    recommendation.
    By
    Board
    order
    of
    December
    14,
    1994,
    the
    Board
    granted
    the
    Agency
    until
    December
    14,
    1994
    to
    file
    the
    recommendation.
    The
    Agency
    filed
    its
    recommendation
    on
    December
    20,
    1994
    and
    it
    is
    therefore
    6
    days
    late.
    The
    motion
    to
    allow
    filing
    of
    the
    Agency
    recommendation
    instanter
    is
    hereby
    granted.
