INTERIM ORDER OF THE BOARD

(by Dr. Satchell):

1.

The petition for order authorizing transfer of variances

and petition to intervene are deemed

a request to trans-

fer variances and a new petition for variance by Inverness

Mining Company.

2.

The variances previously granted in PCB 77-203 and

PCB 79-149 to Allied Chemical Corporation for operation

of the Minerva Mine and Spivey Mill in Hardin County are

transferred to Inverness Mining Company.

These variances

will expire upon the entry of

a Final Board Order on

Inverness Mininq Company’s petition for variance.

3.

The request for emergency hearing is deemed

a motion for

expedited consideration of the request to transfer

variances and as such is granted.

4.

Within fifteen days of the date of this Interim Order,

Inverness Mining Company shall execute and forward to

the Illinois Environmental Protection Agency,

a Certificate of Acceptance and Agreement to be bound to

all terms and conditions of the variances previously

granted Allied Chemical Corporation in

PCB 77-203 and

PCB 79-149.

The form of the certificate shall be

PCB 80-92, hereby accept that Interim Order and agree to

be bound by all the terms and conditions of the variances

previously granted Allied Chemical Corporation in PCB
