This matter comes before the Board on September
12 and 22,
1989 motions for extensions of time
filed by the City of Geneva
(Geneva).
In support
of its September
12 motion, Geneva states that
it
was unable
to formulate its response by September
12 to the
Illinois Environmental Protection Agency’s (Agency) variance
recommendation that
it received on September
5.
Geneva
represents that the Agency has no objection to this motion.
It
requests an extension of
the time to file its response until
September
22,
1989.
In support
of its September
22 motion, Geneva states that
it
has entered into ongoing negotiations with the Agency that are
likely
to settle remaining issues
in this matter.
Geneva
represents
that the Agency has no objection to this motion.
Geneva also represents that
it has submitted
a waiver of the due
date
for
the decision deadline
in
this matter until December
15,
1989.
It requests an extension of the
time
to file its response
until October
13,
1989.
The Board hereby denies Geneva’s September
12 motion as
moot;
it is now several days past the date requested.
The Board
hereby grants Geneva’s September
22 motion for an extension of
time to file its response
to the Agency’s recommendation until
October
13,
1989;
the decision waiver until December 15 avoids
potential
time conflicts, and the Agency has not objected
to this
extension.
