NOW COMES the Petitioner, by its Attorneys, James T. Harrington, David R. Rieser and
McGuireWoods LLP and for its Response to Respondent's Motion for Leave to File the Administrative
Record on a Set of Compact Discs, states as follows

Petitioner has no objection to the Respondent filing the Administrative Record on a set of
compact discs as set forth in the Respondent's Motion provided that Respondent provides a complete

record, Respondent agrees that hard copies of the documents will be promptly provided to the Board and
