HEARING OFFICER ORDER
On November 18, 2004, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that it and respondents Wooten Construction,
Ltd., and Smithfield Properties L.L.C., are discussing technical issues as well as some discussion
of the penalty demand. The complainant represented that it and the respondent

., are close to reaching a settlement and that discussions continue.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on January 20, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
