INTERIM ORDER OF THE BOARD

The Petition for Variance in this matter,
filed November 22,
1976,
is inadequate.
Specifically, the Petition fails
to address
reasons why further Variance is needed for the subject facility,
in
light of prior testimony to the effect that compliance with the
relevant cyanide standards would be achieved by December
6,
1976.

Further,
the Petition fails to include by reference the
applicable specific portions of prior Variance proceeding Records.
It is the Order of the Board that Petitioner shall amend its
Petition within forty—five
(45)
days of the date of this Order to
provide
the above described information.
Failure to timely file
the amended petition shall cause
the Petition
to be dismissed for
inadequacy without prejudice.
The 90-day decision period set by
statute shall run from the date of filing of the amended petition.
